1. Who we are
Canalhouse Network (the "Network") at network.canalhouse.agency is run by Canalhouse LLC, a Massachusetts company ("Canalhouse", "we", "us"). The Network is a private, curated directory of talent, makers and founders chosen by Canalhouse.
These terms apply to everyone who uses the Network: applicants, members, subscribers, consulting clients and partners. By using the Network you agree to these terms, to our Acceptable use policy and to our Privacy policy. If you don't agree, please don't use the Network.
2. Eligibility
You must be at least 18 years old to apply, hold an account, subscribe or otherwise use the Network. By using it, you confirm that you are.
If you use the Network on behalf of a company or other organisation, you confirm that you have authority to accept these terms for it, and "you" includes that organisation.
3. Accounts and sign-in
The Network uses passwordless sign-in. When you sign in, we email a link to your address, and following that link signs you in.
Sign-in links and accounts are personal. Please don't forward your links or share your access with anyone else. You're responsible for keeping your email account secure and for activity that happens through your account.
Please keep your email address up to date so we can reach you about your account.
4. Applications
Anyone aged 18 or over may apply to join at /apply. Applying doesn't create a working relationship or any obligation on either side.
We review applications personally, but we can't respond to every one, and we may decline any application without giving a reason.
You confirm that what you submit is accurate and that you have the right to share any photos, links or other material you include.
5. Membership and profiles
Membership is by invitation only. Applying, being referred, subscribing or working with us as a consulting client does not make you a member.
A member profile appears in the Network only once it is complete and approved. You can hide your profile at any time from your account. We may edit, hide or remove any profile, or end a membership, at our discretion.
You keep ownership of everything you add to your profile. You give Canalhouse a non-exclusive, royalty-free licence to host, store, display, resize and crop that content in order to run the Network, including on public teaser pages as described in our Privacy policy. Your profile may also appear on canalhouse.agency, but only if you and Canalhouse both agree.
This licence ends when your profile is removed, except for copies kept for a limited time in routine backups and records we need to keep for legal reasons.
You're responsible for making sure your profile is accurate and that you have the rights to everything in it.
6. Proposed profiles
Sometimes Canalhouse prepares a profile for someone before they join, using publicly available information and photos, and sends them a private link to review it.
A proposed profile is never shown in the Network unless the person accepts it. Before accepting, they can edit it. If they decline, we delete the photos and details and keep only their name, their email if they gave one, and the date they declined, so that we don't ask them again.
Once you accept a proposed profile, these terms apply to it in the same way as to any other member profile, and you can edit or hide it at any time.
7. Subscriptions and billing
Subscribers pay a monthly fee to browse profiles and request introductions. There are two plans: one discipline, or all disciplines. The price is shown before you check out.
Payments are processed by Stripe. We don't see or store your card number. Subscriptions renew automatically each month until cancelled, and you authorise us, through Stripe, to charge your payment method at each renewal.
You can cancel at any time from your account. Your access continues until the end of the period you've already paid for, and then stops. We don't refund partial periods unless the law requires it.
On the one-discipline plan, you can switch to a different discipline once every 30 days. If you upgrade to all disciplines, the change takes effect straight away and the charge is prorated for the rest of the current period.
If a payment fails, we or Stripe may try again, and your access may be paused or ended until payment succeeds. If we change our prices, we'll tell you in advance by email, and the new price will apply from your next renewal after that notice.
8. Introductions
Subscribers can ask Canalhouse for an introduction to a member. Introductions are always made through Canalhouse. Subscribers never receive a member's contact details directly from the Network.
Canalhouse decides whether and how to make an introduction, and may decline a request for any reason. A request doesn't guarantee an introduction, a reply or any outcome.
Any arrangement you make after an introduction is between you and the other person. Canalhouse is not a party to it and isn't responsible for it unless we agree otherwise in writing.
9. Consulting clients and agreements
If you work with Canalhouse as a consulting client, you'll have a private plan in the Network and may sign agreements with us electronically in the app.
When you sign electronically, you agree that your electronic signature is as binding as a handwritten one. We keep an audit record of each signature, as described in our Privacy policy.
Your signed agreement governs the work we do together. If anything in these terms conflicts with a signed agreement, the signed agreement wins.
10. Partners
Referral partners can earn a share of subscription payments from subscribers they refer. Referrals are tracked through a partner link, which is remembered for 60 days, or through a promo code.
The details of each partnership, including how shares are calculated and paid, are set out in a separate partner arrangement with Canalhouse. If anything in these terms conflicts with that arrangement, the partner arrangement wins.
11. Acceptable use
Everyone who uses the Network must follow our Acceptable use policy at network.canalhouse.agency/acceptable-use. In short: don't scrape or copy profiles, don't go around introductions, don't harass anyone, be honest about who you are, and don't share your account.
If you break the policy or these terms, we may suspend or end your access.
12. Content and intellectual property
The Network itself, including its design, text, software and the Canalhouse name and marks, belongs to Canalhouse or its licensors. You may use it only as these terms allow.
Profiles, photos and other content in the Network belong to the members and others who provided them. Access to the Network doesn't give you any right to copy, download, republish or otherwise use that content outside the Network.
If you send us feedback or ideas, we may use them without any obligation to you.
13. Privacy
Our Privacy policy at network.canalhouse.agency/privacy explains what information we collect, how we use it and the choices you have. Our Cookies page at network.canalhouse.agency/cookies explains the few cookies we use.
14. Disclaimers
Canalhouse curates the Network with care, but we don't verify every detail in every profile or application, and we can't promise that the Network will always be available or free of errors.
We don't guarantee any booking, introduction, partnership, investment, hire or other outcome from using the Network.
To the fullest extent the law allows, the Network is provided "as is" and "as available", and we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.
15. Limitation of liability
To the fullest extent the law allows, Canalhouse will not be liable for any indirect, incidental, special, consequential or punitive losses, or for any loss of profits, revenue, data or opportunity, arising from your use of the Network.
To the fullest extent the law allows, our total liability to you for all claims relating to the Network is limited to the amount you paid Canalhouse for the Network in the 12 months before the claim, or 100 US dollars if you paid nothing.
Nothing in these terms limits any liability that cannot be limited under applicable law. If you have a signed consulting agreement or partner arrangement with us, the liability terms in that document apply to the work it covers.
16. Termination
You can stop using the Network at any time. Subscribers can cancel from their account, and anyone can ask us to close their account through canalhouse.agency/contact.
We may suspend or end your access at any time if you break these terms or our Acceptable use policy, if we need to protect members or the Network, or if the law requires it. If we end a paid subscription for any other reason, we'll refund the unused part of the current period.
Sections that by their nature should continue after your access ends, such as content and intellectual property, disclaimers, limitation of liability and governing law, will continue to apply.
17. Changes to these terms
We may update these terms from time to time. We'll change the effective date at the top of this page, and if a change is significant, we'll let you know by email or in the Network before it takes effect.
If you keep using the Network after a change takes effect, you accept the updated terms. If you don't agree, please stop using the Network and cancel any subscription.
18. Governing law
These terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of laws rules.
Any dispute relating to these terms or the Network will be handled by the state or federal courts located in Massachusetts, and you and Canalhouse agree to the jurisdiction of those courts, unless the law where you live gives you the right to bring a claim elsewhere.
